1. Introduction & Scope
Evorra Padel Limited is committed to providing a safe, welcoming and professionally managed sporting environment.
This disclaimer applies to individuals participating in padel, pickleball, coaching, lessons, tournaments, social sessions and other sporting activities organised or provided at facilities operated by Evorra Padel Limited.
Sporting activities involve inherent risks which cannot be entirely eliminated, even where appropriate safety precautions are in place.
This document explains those risks, the responsibilities of participants and the extent of Evorra Padel Limited's legal responsibilities.
Nothing in this disclaimer excludes or restricts statutory rights or any liability that cannot lawfully be excluded or restricted.
2. Participation & Inherent Sporting Risks
Padel and pickleball are physical activities involving movement, exertion, rapid changes of direction and interaction with other players, sporting equipment and court surroundings.
Potential risks include:
- Slips, trips and falls.
- Muscle strains, sprains and other sporting injuries.
- Collisions with other participants.
- Contact with rackets, paddles or balls.
- Contact with court surfaces, glass walls, fencing, nets and other court structures.
- Injuries resulting from sudden movements, twisting or overexertion.
- Accidental injuries during recreational or competitive play.
Participants acknowledge that these risks are inherent to sporting activity and cannot be completely eliminated.
All participants are expected to exercise reasonable care, play within their abilities and take appropriate precautions to protect themselves and others.
3. Health & Fitness to Participate
Participants are responsible for considering whether they are physically fit and able to participate safely.
Anyone with an existing injury, medical condition or health concern that may affect their ability to participate should seek appropriate medical advice where necessary.
Participants should notify their coach or activity organiser of any relevant medical information or physical limitations reasonably necessary for safe participation.
Individuals must stop participating if they experience pain, dizziness, injury, illness or any other symptoms that make continued activity unsafe.
Evorra Padel Limited reserves the right to refuse or discontinue participation where reasonable concerns arise regarding an individual's immediate safety or fitness to participate, subject to applicable legal obligations.
4. Footwear & Clothing
Participants are strongly advised to wear appropriate padel or court-specific footwear designed to provide suitable grip, stability and support for the playing surface.
Ordinary trainers and other non-specialist footwear may not provide the same level of support or traction and may increase the risk of slipping, falling or sustaining an injury.
Participants who choose to wear non-specialist footwear should understand these additional risks.
All footwear must be clean, non-marking, suitable for the court surface and must not cause damage.
Clothing should be suitable for physical activity and must not create an avoidable safety hazard.
Evorra Padel Limited reserves the right to refuse participation where footwear or clothing presents a reasonable safety concern.
5. Rackets, Paddles & Equipment Safety
All sporting equipment must be appropriate for its intended purpose and maintained in a safe condition.
Padel racket wrist straps must be securely worn around the wrist at all times during play.
Padel rackets with missing, damaged or defective wrist straps must not be used.
Where pickleball paddles are fitted with wrist straps or safety tethers, these must also be used during play.
Participants must not use damaged, defective or otherwise unsafe equipment.
Any concerns regarding equipment provided by Evorra Padel Limited must be reported promptly.
Participants using their own equipment are responsible for ensuring that it is suitable and safe for use.
6. Safe Participation & Personal Responsibility
Participants are expected to exercise reasonable care and attention throughout sporting activities.
This includes:
- Playing within their own abilities and physical limitations.
- Remaining aware of other players and their surroundings.
- Using sporting equipment safely and appropriately.
- Avoiding reckless or unnecessarily dangerous actions.
- Following relevant safety instructions.
- Reporting hazards or unsafe conditions promptly.
- Stopping participation where continued activity presents an unreasonable risk.
Participants must take reasonable steps to avoid causing injury to themselves or others.
Evorra Padel Limited may operate without staff physically present during certain opening hours. Participants acknowledge that immediate on-site staff assistance may not be available during these periods. Evorra Padel Limited remains responsible for meeting its applicable legal duties relating to the safety and operation of its facilities.
Evorra Padel Limited may stop an activity or prevent continued participation where necessary to address a genuine safety concern.
7. Coaching, Lessons & Organised Activities
Participation in coaching, lessons, tournaments, organised social sessions and other sporting activities involves the normal risks associated with physical exercise and sporting participation.
Participants must follow reasonable safety instructions issued by coaches, instructors and authorised activity organisers.
Participants should disclose relevant medical conditions, injuries or physical limitations where reasonably necessary to support their safe participation.
Coaching and instruction are intended to support skill development but do not guarantee any particular improvement, performance level or sporting result.
Where an activity is provided by an independent coach or organisation, the identity and responsibilities of that provider should be made clear to participants.
8. Accidents, Injuries & Incident Reporting
All accidents, injuries, near misses, unsafe conditions and equipment defects should be reported to a member of staff or the designated venue contact as soon as reasonably practicable.
Participants should seek appropriate medical attention where necessary.
Where urgent medical assistance is required, emergency services should be contacted immediately.
Evorra Padel Limited may record relevant incident information for safety, safeguarding, insurance and legal purposes in accordance with its Privacy Policy.
Reporting an incident does not, in itself, establish liability on the part of Evorra Padel Limited or any other individual.
9. Personal Belongings & Property Liability
Participants are responsible for taking reasonable care of their own personal belongings and property.
This includes clothing, bags, footwear, jewellery, mobile phones, rackets, paddles, other sporting equipment and vehicles.
Participants should avoid bringing unnecessary valuables to the venue and should use any designated storage facilities appropriately.
Evorra Padel Limited does not accept responsibility for loss, theft or damage to personal belongings where it has not breached a relevant legal duty.
Nothing in this section excludes liability arising from negligence or any other liability that cannot lawfully be excluded.
10. Hire Equipment, Damage & Financial Responsibility
Participants using rackets, paddles or other equipment provided by Evorra Padel Limited are responsible for taking reasonable care of that equipment.
Hire equipment must be used for its intended purpose and returned in accordance with the applicable hire arrangements.
Participants must report any damage, defect or safety concern promptly.
Evorra Padel Limited may recover reasonable repair or replacement costs where hire equipment is lost or damaged as a result of deliberate damage, negligence or misuse, where legally recoverable.
Normal wear and tear arising from appropriate use will not result in additional charges.
Participants may also be responsible for reasonable costs arising from damage to courts, fixtures or other property caused by deliberate acts, negligence or misuse, where legally recoverable.
Any proposed charges will be assessed fairly, taking account of the circumstances, evidence and applicable consumer law.
11. Children & Junior Sporting Participation
Children and young people participating in sporting activities are exposed to the normal inherent risks associated with the relevant sport.
Parents and guardians should consider whether an activity is suitable for their child's age, ability, experience and individual needs.
Relevant medical information, allergies, injuries or other safety considerations should be communicated to the coach or organiser where reasonably necessary.
Where a parent or guardian registers a child for an activity, they acknowledge the relevant sporting risks and participation requirements on the child's behalf.
Nothing in this disclaimer removes or restricts a child's statutory rights or the legal duties owed to children by Evorra Padel Limited or other responsible providers.
Practical supervision arrangements and behaviour requirements are addressed separately in the Venue Rules & Code of Conduct and any applicable junior activity terms.
12. Limitation of Liability
Evorra Padel Limited takes reasonable steps to maintain its facilities and provide services with appropriate care and skill.
However, participation in sport carries inherent risks, and the occurrence of an accident or injury does not automatically establish negligence or legal liability.
To the extent permitted by law, Evorra Padel Limited is not responsible for losses or injuries arising solely from the ordinary risks of sporting participation, a participant's own unsafe conduct or circumstances for which Evorra Padel Limited has no legal responsibility.
Nothing in this disclaimer excludes or restricts liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot lawfully be excluded or restricted.
Nothing in this disclaimer affects rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation.
13. Insurance
Evorra Padel Limited will maintain business insurance appropriate to its operations and applicable legal requirements.
The existence of business insurance does not necessarily mean that every participant is covered by personal accident insurance or that every sporting injury will give rise to an insurance claim.
Participants who wish to obtain additional personal accident protection may consider arranging their own insurance.
The availability and extent of any insurance cover will depend on the applicable policy terms.
14. Acceptance & Acknowledgement
By making a booking or participating in a sporting activity operated by Evorra Padel Limited, participants acknowledge that:
- They have been informed of the inherent risks associated with padel, pickleball and related sporting activities.
- They are responsible for considering their own fitness and ability to participate safely.
- They are expected to exercise reasonable care and follow relevant safety instructions.
- They understand the importance of suitable footwear and safe sporting equipment.
- They must wear padel racket wrist straps and use pickleball safety tethers where fitted.
- They are responsible for taking reasonable care of their personal belongings.
- They may be responsible for reasonable costs arising from damage to hire equipment or venue property caused by negligence, misuse or deliberate acts, where legally recoverable.
- They must report relevant accidents, injuries, equipment defects and safety concerns.
- They understand that the venue may operate without staff physically present and that immediate on-site assistance may not always be available.
- They understand that participation involves risks that cannot be entirely eliminated.
- Their statutory rights remain unaffected.
The person making a group booking is responsible for directing other participants to the applicable participation and safety information.
Where a parent or guardian registers a child, their acknowledgement does not waive or restrict the child's legal rights.
15. Relationship With Other Policies
This disclaimer should be read alongside Evorra Padel Limited's:
- Venue Rules & Code of Conduct.
